Filing with the Office of the DENR Secretary a letter seeking to have the order of cancellation of Ipilan Nickel Project's ECC reconsidered
Background/Description of the Disclosure
Further to the Company’s disclosure on December 16, 2016 regarding the cancellation by the Department of Environment and Natural Resources (DENR) of the Environmental Compliance Certificate (ECC-CO-1006-0017) for the Ipilan Nickel Project (the “Project”) in Brooke’s Point, Palawan, the Company confirms that Ipilan Nickel Corporation (INC) has recently filed with the Office of the DENR Secretary a letter seeking to have the order of cancellation reconsidered. INC chronicles in its letter the scores of significant programs and activities it implemented and continues to implement (e.g. lodging of Community Development Programs with various beneficiaries, confirmatory drilling, preparation and submission of Definitive Project Feasibility Study, EPEP, SDMP, 3-Year Work Program, Survey Oder, LGU endorsements and application for MPSA Operation, land acquisition for road lots and foreshore lease application, commissioning and completion of Environmental Assessment Update Studies and numerous meetings with the Mine Rehabilitation and Fund Committee) to pursue the Project as well as the timeline of major approvals (e.g. Operating Agreement, Change in Status of the MPSA to Construction and Operation, Partial Declaration of Mine Project Feasibility, Special Tree-Cutting Permit and Earth-Balling Permit) it obtained from different DENR offices and other pertinent agencies. Based on records, INC maintains that the lone basis for the cancellation of its ECC (i.e. that “the Project was never implemented”) has no factual basis.
