Favorable Resolution In West Tower Condominium Corporation vs. Garde, et al. (Criminal Complaint / NPS No. XV-05-INV-11J-02709)

Background/Description of the Disclosure

Background:

In connection with the leak of petroleum products from the First Philippine Industrial Corporation’s (“FPIC”) white oil pipeline, the West Tower Condominium Corporation filed on 15 October 2011 a complaint for violation of Article 365 of the Revised Penal Code (“Complaint”) against several directors and officers of Pilipinas Shell Petroleum Corporation (the “PSPC”). PSPC used the said pipeline to transport its products from the Tabangao Refinery to its former Pandacan terminal. PSPC, a customer of FPIC, was not involved in the day-to-day operations of FPIC.

Update:

In the Resolution dated 22 February 2017, which was received on 07 March 2018, the Office of the City Prosecutor of Manila dismissed the Complaint for lack of probable cause. The Resolution stated that the directors and officers of the Corporation were not under obligation to operate and maintain the pipeline belonging to FPIC. Hence, they are not personally liable for negligence.
