Clarification of News Report
We confirm that a draft department administrative order (DAO) on the above topic was circulated last week to mining companies for comment and review. We also understand, based on the DENR’s presentation on this matter, that the draft DAO intends to cover mineral agreements, financial or technical assistance agreements and other similar mining tenements involving surface metallic mines under the development/construction or operating period, and, more specifically, Nickel Mines. Since Philex presently has no nickel mine, it is not in a position to comment on this matter at this time. Nonetheless, please rest assured that Philex will issue an accurate disclosure on the draft DAO once it is issued and is determined to be applicable to its operations.
