Subject of the Disclosure
MRC filed a Criminal Complaint against Kyocera Group for Estafa under Art. 315 par. 2 (a) of the Revised Penal Code.
Background/Description of the Disclosure
We would like to inform the Exchange that on June 04, 2024, MRC Allied Inc. (“MRC”) through its President & CEO, Mr. Augusto M. Cosio, Jr., filed a Criminal Complaint against GORO YAMAGUCHI in his capacity as former President & Executive Officer of KYOCERA CORPORATION, HIDEO TANIMOTO in his capacity as President & Executive Officer of KYOCERA CORPORATION and MR. KATSAYUKI WAKI in his capacity as Executive Officer of KYOCERA CORPORATION and as President of KYOCERA CRYSTAL DEVICES PHILIPPINES INC. at the Office of the Provincial Prosecutor , for the Province of Cavite. The Criminal Complaint was docketed as NPS Docket No. IV-03-INV-24F-1054, for Estafa under Article 315 (2) (a) of the Revised Penal Code (RC) arising from the Kyocera Group’s malicious, fraudulent and deceitful scheme specifically designed to divest MRC of its ownership over the 34,750 Square Meters of Industrial Estate Property located at Naga City, Cebu and defeat MRC’s rights granted by operation of law under either Article 449 or Article 1678 of the Civil Code, as amended. Another count for the said offense was charged in the same Criminal Complaint for the malicious, fraudulent and deceitful scheme of Kyocera Group specifically designed to render moot and futile the Unlawful Detainer Case filed by MRC tor recover possession of the aforementioned Industrial Estate Property.
