Decision of the Court of Appeals on the petition filed by PTT against National Telecommunications Commission (NTC)

Background/Description of the Disclosure

On 11 December 2019, PTT received the Decision rendered by the Court of Appeals requiring NTC to recompute the amount of the Supervision and Regulatory Fee (SRF) it is collecting from PTT.

Nature and description of the legal proceedings

PTT filed the Petition with the Court of Appeals to question the amount of the SRF that NTC is collecting. The computation of NTC is incorrect since it is based on its erroneous interpretation of what constitutes PTT's paid-up capital.

The Court of Appeals rendered a Decision remanding the case to NTC and further requiring NTC to recompute the SRF due from PTT.
