Nature and description of the legal proceedings

PT&T initially filed an appeal with the Court of Appeals to assail the decision of the National Telecommunications Commission (NTC) on the amount of the Supervision and Regulation Fee (SRF) that it is collecting from PT&T. While PT&T is required to pay an annual SRF, the amount being collected by the NTC is inaccurate because it was computed by the NTC based on its erroneous assumption of the amount of PTT’s paid-up capital. This is relevant because the SRF is to be computed based on an entity’s paid-up capital.

The Court of Appeals rendered a decision remanding the case to the NTC and required the NTC to re-compute the SRF due from PT&T. While the Court of Appeals required the NTC to re-compute the SRF, the Court of Appeals nevertheless affirmed the use by the NTC of the incorrect amount of PT&T’s paid-up capital in computing the SRF.

Considering this erroneous ruling of the Court of Appeals, PT&T was constrained to file an appeal with the Supreme Court to rectify the said error.
